Zenith Motors is a global automotive trading company specializing in the import, export, and international sourcing of new vehicles. Our services include locating vehicles through our international supplier network, facilitating purchase, and arranging export and international delivery where agreed.

Vehicles displayed on the Website are illustrative of the types of vehicles we can source. Their appearance on the Website does not constitute an offer to sell, a guarantee of availability, or a confirmation of price. All sales are subject to a separate written agreement, quotation, or sales invoice (“Sales Agreement”) between you and Zenith Motors.

Submitting an enquiry form, message, or product request through the Website does not create a binding contract. It is a request for information only.

A binding contract is formed only when we issue a written quotation or proforma invoice that you accept in writing, and we confirm acceptance of your order and receipt of any required deposit. We reserve the right to decline or cancel any enquiry or order at our discretion, including where a vehicle becomes unavailable, where pricing is incorrect, or where we are unable to complete required verification checks.

Quotations are valid only for the period stated on them, or for seven (7) days where no period is stated, and are subject to vehicle availability at the time of order confirmation.

All prices are quoted in the currency stated on the relevant quotation or invoice and, unless expressly stated otherwise, are exclusive of taxes, duties, customs charges, registration fees, insurance, inland and international freight, port handling, and any other third-party charges.

Prices displayed on the Website (including any figures shown in product listings) are indicative only, may be placeholders, and are not binding. The applicable price is the price stated in your confirmed Sales Agreement.

Unless otherwise agreed in writing:

A non-refundable deposit is payable to confirm an order and to reserve or begin sourcing a vehicle.
The balance is payable in cleared funds before the vehicle is shipped or released.
Title to the vehicle passes to you only upon our receipt of payment in full.
We are not obliged to ship, release, or deliver any vehicle until full payment and all applicable charges have been received.

You are responsible for all bank transfer fees and any currency exchange costs. We are not responsible for delays caused by payment processing, banking systems, or failed or incomplete transfers.

Vehicle descriptions, images, specifications, trims, ranges, battery capacities, and equipment lists are provided by manufacturers and suppliers and are believed to be accurate at the time of publication. However, they are provided for general guidance only.

Manufacturers may change specifications, features, colours, and equipment without notice. Actual vehicles may differ from images and descriptions shown. We do not warrant that any description, image, or specification on the Website is complete, current, or error-free. You should confirm the exact specification of any vehicle in writing before placing an order.

Vehicles sourced for export may be manufactured to specifications for a particular market and may not comply with the regulations, standards, or homologation requirements of your destination country. It is your responsibility to verify compliance before purchase (see Section 6).

Where we arrange export or international delivery, we do so as a facilitator using third-party carriers, freight forwarders, and logistics providers. Delivery timeframes are estimates only and are not guaranteed.

We are not liable for delays, damage, or loss arising from causes beyond our reasonable control, including but not limited to customs inspections and clearance, port congestion, shipping line schedules, weather, strikes, war, sanctions, or acts of government.

Unless your Sales Agreement expressly states otherwise, delivery terms (for example EXW, FOB, CIF, or DAP as defined by the current Incoterms) will be specified in the Sales Agreement, and risk in the vehicle passes to you in accordance with the agreed Incoterm. You are responsible for arranging appropriate marine and transit insurance unless we have agreed in writing to provide it.

You are solely responsible for:

Ensuring that the import and registration of the vehicle is lawful in your destination country;
All import duties, customs charges, value-added or sales taxes, registration fees, and other governmental levies in the destination country;
Obtaining any licences, permits, certificates of conformity, or homologation required for import and registration;
Ensuring that the vehicle meets the emissions, safety, left/right-hand drive, and technical standards of the destination country.

We do not provide legal, tax, or customs advice. Any general information we provide about import requirements is offered as a courtesy only and must not be relied upon as professional advice. You should consult qualified customs and legal advisors in the destination country before purchasing.

You warrant that you are not subject to, and will not use our vehicles or services in breach of, any applicable sanctions, embargoes, or export-control laws. We may refuse or cancel any transaction, without liability, where we reasonably believe it may breach such laws or expose us to sanctions risk. You agree to provide any documentation we reasonably require to comply with anti-money-laundering, sanctions, and “know your customer” obligations.

New vehicles may carry a manufacturer’s warranty. The scope, validity, and territorial coverage of any manufacturer’s warranty are determined solely by the manufacturer and may not apply, or may be limited, when a vehicle is exported outside its intended market. We do not extend, guarantee, or assume responsibility for any manufacturer’s warranty.

Except for any warranty expressly stated in your Sales Agreement and any rights that cannot lawfully be excluded, all vehicles and services are provided without further warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Because vehicles are sourced and imported to order, orders generally cannot be cancelled once confirmed. Deposits are non-refundable except where expressly stated in your Sales Agreement or required by law.

Any cancellation, return, or refund rights, and any associated charges, will be governed by the terms of your Sales Agreement. Requests to cancel or amend a confirmed order must be made in writing and are subject to our acceptance and to costs already incurred.

Where practicable, you or your agent may inspect a vehicle before shipment. You are responsible for notifying us in writing of any visible discrepancy or damage within the period stated in your Sales Agreement, or otherwise within seven (7) days of delivery. Failure to notify within the applicable period constitutes acceptance of the vehicle in the condition delivered, save for latent defects not reasonably discoverable on inspection.

All content on the Website, including text, logos, images, graphics, and the “Zenith Motors” name and branding, is owned by or licensed to us and is protected by intellectual property laws. You may view and use the Website for your own lawful, non-commercial purposes only. You may not copy, reproduce, republish, or exploit any Website content without our prior written consent.

You agree not to use the Website in any way that is unlawful, fraudulent, or harmful, or to interfere with its operation or security.

The Website may contain links to third-party websites and social media platforms. These are provided for convenience only. We do not control and are not responsible for the content, products, or practices of any third-party site.

To the fullest extent permitted by law, Zenith Motors shall not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profit, revenue, business, or anticipated savings, arising out of or in connection with the Website, our services, or any transaction.

Our total aggregate liability arising out of or in connection with any transaction shall not exceed the total amount paid by you to us for the specific vehicle or service giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.

You agree to indemnify and hold harmless Zenith Motors and its officers, employees, and affiliates against any claims, losses, liabilities, and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or your failure to comply with import, export, customs, or regulatory requirements in any jurisdiction.

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government action, sanctions, strikes, supplier or manufacturer failures, shipping disruptions, or failures of telecommunications or payment systems.

Any personal data you provide (for example through enquiry forms or the newsletter) will be handled in accordance with our Privacy Policy and applicable data-protection laws. By submitting your details, you consent to us contacting you about your enquiry and, where you have opted in, sending you updates and promotions. You may unsubscribe from marketing communications at any time.

We may update these Terms from time to time. The version published on the Website at the time you submit an enquiry or place an order applies to that transaction. We encourage you to review these Terms periodically. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.

These Terms, and any dispute or claim arising out of or in connection with them or the Website, shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai. You agree to submit to the exclusive jurisdiction of the courts of Dubai, UAE, without prejudice to any mandatory rights you may have under the laws of your own country of residence.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force. These Terms, together with your Sales Agreement and our Privacy Policy, constitute the entire agreement between you and Zenith Motors regarding the subject matter and supersede any prior understandings.
